These Terms of Use apply to your use of the StSwo Tech services, including its fitness and nutrition software applications (collectively referred to as "Services"). These Terms create an agreement between you and StSwo Tech and contain important provisions regarding the resolution of disputes through arbitration. By using our Services, you agree to these Terms.
Our Privacy Policy explains how we collect and use personal information. Although it is not part of these Terms, it is an important document that you should read.
StSwo Tech is not a healthcare provider, medical professional, or licensed dietitian. The Services, including any artificial intelligence (AI) generated diet plans, workout routines, calorie tracking, barcode scanning results, and any other Content or Output, are provided for general informational and educational purposes only.
You expressly agree that your athletic activities, dietary changes, and use of our Services carry certain inherent and significant risks of property damage, bodily injury, or death. You voluntarily assume all known and unknown risks associated with these activities.
Always consult with a qualified healthcare professional or physician before starting any new diet, fitness program, or nutrition plan, especially if you have pre-existing medical conditions, injuries, or are pregnant. Do not disregard professional medical advice or delay in seeking it because of something you have read or generated on our Services.
Minimum Age: You must be at least 13 years old or the minimum age required by your country to use the Services. If you are under 18, you must have the permission of a parent or legal guardian.
Registration: You must provide accurate information during registration. You cannot share your account credentials. You are responsible for all activities under your account.
What You Can Do: Subject to your compliance with these Terms, you may access and use our Services.
What You Cannot Do: You may not use our Services for illegal, harmful, or abusive activities. You may not:
Your Content: You may provide input to the Services ("Input"), such as physical metrics, dietary preferences, or food images, and receive output ("Output"), such as AI-generated workout plans or calorie estimations. You are responsible for ensuring your Content does not violate any laws.
Accuracy of AI and Nutritional Data: Due to the probabilistic nature of machine learning and reliance on third-party databases (e.g., barcode repositories), Output from our Services may not always be 100% accurate, complete, or up-to-date.
Billing and Subscriptions: For paid premium subscriptions, you will provide complete and accurate billing information. Subscriptions automatically renew until canceled. Payments are processed through the respective app store (Apple App Store or Google Play Store) or our third-party payment providers, subject to their terms.
Cancellation: You can cancel your paid subscription at any time through your device's account settings. Payments are non-refundable except where required by law.
Advertisements: Free versions of our Services may display third-party advertisements. We are not responsible for the content, products, or services provided by these third-party advertisers.
If you downloaded the app from the Apple App Store or Google Play Store, you acknowledge that these Terms are between you and StSwo Tech, not with Apple Inc. or Google LLC. Apple and Google are not responsible for the Services, do not provide maintenance or support, and are not liable for any warranty claims, product liability, or intellectual property infringement claims regarding the Services.
We and our affiliates own all rights, titles, and interests related to the Services. You may use our name and logo only with our permission.
You are free to stop using our Services at any time. We reserve the right to suspend or terminate your access to our Services or delete your account if you violate these Terms, if required by law, or if your account has been inactive for over a year (for non-paid accounts).
OUR SERVICES ARE PROVIDED "AS IS." WE MAKE NO WARRANTIES (EXPRESS OR IMPLIED) WITH RESPECT TO THE SERVICES AND DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE NUTRITIONAL DATA, EXERCISE PLANS, OR AI OUTPUT WILL BE ACCURATE, SAFE, OR ERROR-FREE.
NEITHER WE NOR OUR AFFILIATES WILL BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS SERVICE, INCLUDING PHYSICAL INJURY, HEALTH COMPLICATIONS, LOST PROFITS, OR DATA LOSS. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRIOR TO THE EVENT, OR $100, WHICHEVER IS GREATER. LIMITATIONS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Mandatory Arbitration: You and StSwo Tech agree to resolve any disputes arising from these Terms through final and binding arbitration via National Arbitration and Mediation ("NAM").
Class Action Waiver: Disputes must be pursued individually. Class actions and class arbitrations are prohibited.
Exceptions for International Users: If the laws of your country of residence strictly prohibit binding arbitration agreements for consumers, the disputes may be resolved in the competent local courts of your jurisdiction.
Governing Law: These Terms and your use of the Services will be governed by and construed in accordance with the laws of the Republic of Turkey, with the courts and execution offices of K�rklareli having exclusive jurisdiction, excluding its conflict of law principles.
Trade Controls: You must comply with all applicable trade laws and sanctions.
Entire Agreement: These Terms represent the entire agreement between you and StSwo Tech regarding the Services.
